Contest Period

The Gingerbread Dream Home Contest (the “Contest”) will begin on Thursday, November 16, 2017 at 12:00AM Eastern Time (ET) and will end on Wednesday, December 13, 2017 at 11:59PM ET (the “Contest Period”).

Eligibility

Contest is open to all legal residents of Canada (excluding Quebec) who have reached the legal age of majority in their province/territory of residence at the time of entry except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of The Canadian Real Estate Association (the “Sponsor”), Habitat for Humanity GTA, their parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other person or entity that is involved in the administration and/or execution of this Contest (collectively, the “Contest Parties”).

How to Enter

  • No purchase necessary. During the Contest Period, you can enter the Contest by either (a) donating to your local Habitat for Humanity through https://habitatgta.ca/gingerbreaddreamhome or by the No Purchase Necessary option described below;.
  • NO PURCHASE NECESSARY. Donation is not required and does not enhance chance of winning. To enter by mail, without making a donation, clearly print your full legal name, mailing address, phone number where you could be reached and your age at time of entry on a plain piece of paper, and tell us in fifty (50) or more words why you feel your local Habitat for Humanity is important in your community. Mail your submission in a sealed, postage-stamped and hand-printed envelope to: Gingerbread Dream Home 479 Wellington Street W, Toronto, Ontario M5V 1E7. An eligible mail-in submission will be eligible for one (1) entry into the Contest.. Each mail-in entry must be mailed in a separate outer envelope, bearing sufficient postage and must be submitted in English or French. Computer-generated or electronically-reproduced entries will not be accepted. Limit of one (1) no purchase entry request per person per envelope with sufficient postage. All entries become the sole property of the Contest Sponsors and none will be returned for any reason (an “Entry”).
  • All Entries must be received by Wednesday, December 13, 2017 at 11:59 ET. There is a limit of one (1) Entry per person/email address. If it is discovered that any person has attempted to: (i) submit more than one (1) Entry per person/email address or physical address; and/or (ii) use (or attempt to use) multiple names, identities and/or more than one (1) email address or physical address to participate in this Contest; then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from the Contest and all of his/her Entries voided. Use (or attempted use) of multiple names, identities, email addresses, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).
  • IN NO EVENT AND UNDER NO CIRCUMSTANCES WILL ANY PERSON BE PERMITTED TO OBTAIN MORE THAN THE MAXIMUM NUMBER OF ENTRIES AS STATED IN THESE RULES.
  • All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

Entry Requirements

BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASEES (DEFINED BELOW) WILL BEAR NO LEGAL LIABILITY REGARDING THE USE OF YOUR ENTRY BY THE CONTEST PARTIES AND THE RELEASEES (DEFINED BELOW) SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THESE RULES.

The Prizes And Approximate Retail Values

One (1) miniature gingerbread replica of the exterior of the Gingerbread Dream Home featured in the Sponsor’s link. ARV $200 (the “Prize”).

The Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). The characteristics and features of each Prize element, unless otherwise explicitly described above, are at the Sponsor’s sole discretion. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute a Prize or a component thereof with a prize or prizes of equal or greater value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. For an email entry, the Prize will only be awarded to the person who is verified as the “authorized account holder” (see below) of the email account associated with the selected Entry. There is a limit of one (1) Prize. Any and all costs/expenses not specifically included in the Prize description are the sole and absolute responsibility of each confirmed winner.

Winner Selection

At 12:00PM on Thursday, December 14, 2017 (the “Draw Date”), in Toronto, Ontario one (1) Entry will be selected by random draw from amongst all eligible Entries submitted and received in accordance with these Rules (as determined by the Sponsor at its sole discretion). In the event a potential Prize winner is disqualified for failing to comply with these Rules, as determined by the Sponsor at its sole discretion, the Sponsor reserves the right in its sole discretion, to select an alternate eligible entrant through a random draw from among the remaining eligible Entries received in accordance with these Rules (as determined by the Sponsor at its sole discretion).

The odds of winning depend on the number of eligible Entries received during the Contest Period.

The Sponsor or its designated representative will make a minimum two (2) attempts to contact each selected potential Prize winner within two (2) business days of the Draw Date. If a selected entrant cannot be contacted within two (2) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she will be disqualified (and will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).

BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each selected entrant will be required to (a) correctly answer a time limited mathematical skill testing question, and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot (or is unwilling to) accept his/her Prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).

General Conditions

ANYONE DETERMINED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

By participating in this Contest, each entrant: (i) agrees to be bound by these Rules; and (ii) releases the Releasees from any and all liability in connection with this Contest and his/her participation therein. All Entries become the property of the Sponsor.

The Releasees will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website or mobile network; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above.

In the event of a dispute regarding who submitted an email Entry, the Entry will be deemed to have been submitted by the authorized account holder of the email account provided at the time of Entry. “Authorized account holder” is defined as the person who is assigned the email account by the email service provider responsible for the email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email account associated with the selected Entry.

The Sponsor reserves the right, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, subject only to the approval of the Régie, to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.

This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants or Entries.

The Sponsor reserves the right, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest. In the event of any discrepancy or inconsistency between the terms and conditions of the English version of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the French version of these Rules, website and/or point of sale, television, print or online advertising; the terms and conditions of the English version of these Rules shall prevail, govern and control.

Intellectual Property

All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.
